A Path to Swift and Amicable Dispute Resolution in India Mediation, a dynamic alternative dispute resolution (ADR) mechanism,…
Mediation is a process through which a neutral person, generally called a mediator helps the disputing parties to reach a settlement to the satisfaction of both the parties. Any settlement reached through a mediator is a contract between the disputing parties that is binding and enforceable as per law.
The process of mediation is confidential and cannot be disclosed even by the Mediator. Further, it is voluntary, and a structured party-centred process in which parties have total control over the process as well as the outcome of the process of mediation.
Mediation can be done in non-criminal matters and matters that do not involve a legal issue that has to be necessarily decided by the Court. For example – disputes between family members, neighbours, business partners, landlords and tenants, labour unions, management and employees, marital discords, child custody disputes, etc
Speedy, efficient and economical procedure of mediation is one of the major advantages of mediation. Further, the process is flexible, simple, fair, with a friendly and conducive environment. Even the mediator is a non-partial person and has no pre-conceived notions. The process of mediation is mutual and cannot be finalised until the parties in a dispute agree on the same terms and conditions.
